By accessing or using Linguistfy's services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Services Provided

Linguistfy provides professional English-Afrikaans translation, audio transcription, text localisation, and subtitling services. All services are performed and delivered personally by a qualified, native-speaking linguist. I reserve the right to decline any project or content at my sole discretion.

2. Pricing & Payment

All prices are quoted in South African Rand (ZAR) unless explicitly specified otherwise in writing. For international clients, quotes and invoices may be issued in US Dollars (USD). The project calculator on the website provides automated estimates based on standard parameters; binding final pricing will be provided via an official quote or invoice.

Payment structures are determined by the scope of the project and client type:

• Small & Standalone Tasks: Projects under a specific threshold or standalone legal/official documents (e.g., certificates) require 100% upfront payment before work commences.
• Standard & Large Projects: New clients or private individuals are subject to a 50% upfront deposit, with the remaining 50% due upon project completion and prior to delivery of the final files.
• Corporate Clients: Established companies may be eligible for standard billing terms (e.g., Net 14 or Net 30 days), subject to prior written agreement and provision of an official Purchase Order (PO).

Late payments: Invoices not paid within their specified due date are subject to an immediate fixed late payment penalty of R250.00 (or $15.00 USD for international invoices), plus interest at 2% per month (compounded monthly) on all overdue balances. I reserve the right to suspend all ongoing or future work immediately. If an account remains unpaid, I reserve the right to pursue all available collection avenues, including formal legal action through the competent courts of South Africa to recover outstanding debt, accrued interest, penalty fees, and all associated collection costs and legal fees on an attorney-and-client scale.

Rates are subject to change without notice; however, accepted quotes will be honoured at the stated rate for the duration of their specified validity period.

3. Turnaround Times

Estimated delivery dates and times are provided in good faith. Standard delivery times are calculated based on source text volume, complexity, formatting requirements, and current scheduling. Express or priority orders are subject to availability and may incur additional rush fees. Linguistfy is not liable for project delays caused by late or incomplete payments, illegible or delayed source materials, or circumstances beyond my reasonable control (including infrastructure failures or power outages).

4. Client Responsibilities

Clients are entirely responsible for providing accurate, legible, and complete source materials. You warrant that you hold all necessary copyright, legal rights, and permissions to the content submitted to Linguistfy for translation, transcription, or subtitling. Linguistfy accepts no liability for legal, copyright, or intellectual property infringement claims arising from client-submitted content.

5. Confidentiality

I treat all client materials, correspondence, and data as strictly confidential. Your files, project details, and personal information will never be shared, sold, or disclosed to any third party. Source files and completed deliverables are retained securely and solely for the purposes of service delivery, backup records, and quality review.

6. Intellectual Property & Usage Restrictions

Source materials remain the intellectual property of the client at all times. However, all intellectual property rights, copyright, and ownership of the completed translation, transcription, or subtitle output remain exclusively with Linguistfy until full and final payment of the issued invoice has been received.

Strict Usage Restriction: The client is strictly prohibited from publishing, distributing, displaying, using, or benefiting from the delivered work (or any part thereof) in any corporate, commercial, legal, or public capacity until the account is paid in full. Unauthorised use of unpaid materials constitutes an explicit breach of contract and a violation of copyright law.

Upon receipt of full and final payment, all intellectual property rights to the deliverables are transferred entirely to the client, and I retain no rights to reproduce or distribute the work.

7. Revisions & Quality

I am highly committed to delivering accurate, professional, and contextually fluent work. If you believe a deliverable contains an objective error or linguistic oversight attributable to me, you may request a revision within 7 days of delivery. Revision requests must explicitly specify the exact nature and location of the error. Revisions do not apply to changes made to the original brief, stylistic preferences not communicated before project acceptance, or modifications made to the source text after work has begun.

8. Limitation of Liability

Linguistfy operates as a sole proprietorship. To the maximum extent permitted by applicable law, my total liability for any claim, loss, or damage arising from the services provided shall not exceed the actual fees paid by the client for that specific project. I shall not be liable under any circumstances for indirect, consequential, special, or incidental damages, including but not limited to loss of business, profits, revenue, or data.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or services shall be subject to the exclusive jurisdiction of the competent courts of South Africa.

10. Changes to These Terms

I reserve the right to update or modify these Terms of Service at any time. Continued use of Linguistfy's services following any updates constitutes your explicit acceptance of the revised terms. I encourage you to review this page periodically.
